ICT Legal Consulting Studio Legale Associato Balboni Bolognini & Partners with registered offices in Via Borgonuovo, 12 – 20121 Milan (Italy) (hereinafter only “ICTLC”), in its capacity as data controller regarding the processing of personal data pursuant to the Italian applicable law on data protection pro tempore in force (“Italian Data Protection Law”) and the EU Regulation 679/2016 – General Data Protection Regulation (“GDPR”) (hereinafter Italian Data Protection Law and GDPR are collectively referred to as “Applicable Law”) recognises the importance of personal data protection and considers that preserving the confidentiality of your personal data is one of the main objectives of its activity.

Before providing any personal data, ICTLC invite you to carefully read this privacy policy (“Privacy Policy”), since it contains important information regarding the personal data protection and security measures adopted in order to ensure confidentiality and full respect of the Applicable Law. Moreover, this Privacy Policy:

Is intended for the website www.ictlegalconsulting.com (“Website”) whilst it does not apply to other websites that could potentially be accessed by clicking external links;

Is to be construed as an information notice pursuant to Article/Section 13 of the Applicable Law, intended for those who interact with the Website;

Is in conformity with Recommendation n. 2/2001 related to the minimum requirements for online data collection in the European Union, adopted on 17 May 2001 by the Article 29 Working Party.

ICTLC informs you that processing of your data will be carried out in accordance with the principles of, lawfulness, fairness, transparency, accuracy, purpose and storage limitations, data minimisation, integrity and confidentiality. Your personal data will be processed in accordance with the legislative provisions of the Applicable Law and of the confidentiality obligations included therein.

  

1. DATA CONTROLLER AND DATA PROTECTION OFFICER

Pursuant to the Applicable Law, the data controller of the processing activates carried out through the Website is ICTLC as defined above. ICTLC has appointed aa data protection officer (“DPO”) who is freely contactable for any information relating to the processing of personal data by ICTLC (e.g., the list of data processors) at the following address: dpo@ictlegalconsulting.com.

 

2. PERSONAL DATA SUBJECT TO PROCESSING

“Personal Data” means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, mental, economic, cultural or social identity of that natural person.

By means of the Website, ICTLC collects the following Personal Data:

  

a. Browsing Data

The computer systems and software procedures used to operate the Website collect some Personal Data, the transmission of which is an integral part of Internet communication protocols. This information is not collected to be associated with you but, by its very nature, it may allow you to be identified by processing and associating it with data held by third parties. Among collected Personal Data there are IP addresses or domain names of the devices used by you to connect to the Website, the URI (Uniform Resource Identifier) of requested resources, the time of the request, the method used to submit the request to the server, the size of the file received as a reply, the numeric code indicating the status of the reply given by the server (successful, error, etc.) and other parameters regarding your operating system and device environment.

This data is used exclusively for the purposes of obtaining anonymous statistics on the use and proper functioning of the Website to control its correct functioning, to enable ICTLC to correctly provide the various functionalities to you, as well as for security reasons. These Personal Data may also be used to ascertain any liability in cases of alleged computer crimes against the Website or against third parties and they will be deleted after 7 days.

 

b. Data provided on a voluntarily basis

By means of the Website you may voluntarily provide Personal data such as name, e-mail address for subscribing the on-demand service “ICT Insider” or to contact ICTLC via the “Contact Us” form. ICTLC will process these data in accordance with the Applicable Law and on the presumption they refer to you or to third parties who have authorised you to provide them pursuant to an appropriate legal basis which legitimise the processing at stake. In this case, you act as an independent data controller, assuming all relevant obligations and responsibilities according to the Applicable law. In this regard, you hence waive, in the full sense of the term, the right to all disputes, claims, claims for damages due to processing etc., which may be submitted to ICTLC of the said third party whose Personal Data have been processed through your use of the Website in breach of the Applicable Law.

ICTLC collects Personal Data using cookies. You may find further information on the use of cookie and similar technologies here.

 

3. PURPOSES OF THE PROCESSING AND VOLUNTARY OR OBLIGATORY NATURE OF PROVIDING THE DATA

The Personal Data that you provide by using the Website will be processed by ICTLC for the following purposes:

a. Purposes related to the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (e.g., contact request made by using the “Contact Us” form available on the Website, registration to the on-demand service “ICT Insider”);

b. Purposes related to research/statistical analyses on aggregated or anonymous data, without the possibility of identifying the data subject, aimed at measuring the functioning of the Website, traffic, usability, and interest;

c. Purposes related to the compliance with a legal obligation to which ICTLC is subject;

d. Purposes necessary for the establishment, exercise or defence of legal claims or whenever courts are acting in their judicial capacity.

The legal basis for the processing of Personal Data for the purposes referred to in point a) is the provision of a service or the response to a request that does not require you prior consent under the Applicable Law.

The purpose referred to in point b) does not imply the processing of Personal Data, whilst the processing for the purpose referred to in points c) and d) constitutes a legitimate processing of Personal Data within the meaning of the Applicable Law because, once the Personal Data have been provided, the processing is indeed necessary to comply with a legal obligation to which ICTLC is subject or for the establishment, exercise or defence of legal claims.

Providing your Personal Data for the above-mentioned purposes is voluntary, however, any refusal to provide such data may not allow ICTLC to reply to your requests and to comply with legal obligations to which ICTLC is subject.

 

4. RECIPENTS

Your Personal Data may be disclosed, in close relation to the purposes specified above in section 3, only to:

1. subjects necessary for order fulfilment of the services offered through the Website e.g., sending e-mails and analysing data, which typically process Personal Data on behalf of ICTLC as data processors.
2. persons authorised by ICTLC to process Personal Data, that are committed to/ or under an appropriate statutory obligation of confidentiality (e.g., employees and lawyers of ICTLC) (a. and b. are hereinafter collectively referred to as “Recipients”);
3. law enforcement agencies and public authorities when so required by the Applicable Law.

 

5. TRANSFERS

Some of your Personal Data are transferred to Recipients who may be established outside the European Economic Area. ICTLC ensure that the processing of Personal Data by these Recipients is carried out pursuant to the Applicable Law. In fact, the transfer of Personal Data is based alternatively on an adequacy decision or the Standard Contractual Clauses issued by the European Commission. Further details and the signed agreements may be requested to the DPO.

 

6. DATA RETENTION

ICTLC will process your Personal Data only for the duration necessary to achieve the purposes described in section 3 (e.g., ICTLC will process your Personal Data for the on-demand service “ICT Insider” until you will decide to unsubscribe). Apart from the above, ICTLC will retain your Personal Data for a period of time necessary or permitted to comply with the Applicable Law (Artt.2946 and 2947(1)(3) of the Italian Civil Code). Further information regarding the period of retention of Personal Data and the criteria used to determine such period may be required to the DPO.

 

7. YOUR RIGHTS

Pursuant to and to the extent allowed by the Applicable Law, you have the right, at any time, to request to ICTLC access to, rectification, erasure, restriction of the processing concerning your Personal Data or to object to relevant processing activity and to receive in a structured, commonly used and machine-readable format the Personal Data concerning you.

In any case, pursuant to the Applicable Law, you have the right to lodge a complaint with the relevant supervisory authority (the Italian Garante) if you believe that the processing of your Personal Data is against the Applicable Law.

 

8. AMENDMENTS

This Privacy Policy came into force on 25 May 2018. ICTLC reserves the right to amend or to update its content, whether in whole or in part, including following changes in the legal and regulatory obligations regarding data protection. ICTLC will inform you on such amendments and updates through their publication on the Website as soon as they are adopted, and they will be binding from the moment of their publication. ICTLC therefore invites you to visit this section of the Website regularly in order to be aware of the most recent and updated version of the Privacy Policy, so that you are always updated on the processing activities that ICTLC carries out.

2. DATI PERSONALI OGGETTO DI TRATTAMENTO

Per “Dati Personali” si intende qualsiasi informazione riguardante una persona fisica identificata o identificabile con particolare riferimento a un identificativo come il nome, un numero di identificazione, dati relativi all’ubicazione, un identificativo online o a uno o più elementi caratteristici della sua identità fisica, fisiologica, psichica, economica, culturale o sociale.

 

I Dati Personali raccolti dal Sito sono i seguenti:

 

1. Dati di navigazione

I sistemi informatici del Sito raccolgono alcuni Dati Personali la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet. Si tratta di informazioni che non sono raccolte per essere associate a te, ma che per loro stessa natura potrebbero, attraverso elaborazioni ed associazioni con dati detenuti da terzi, permettere di identificarti. Tra questi ci sono gli indirizzi IP o i nomi a dominio dei dispositivi utilizzati per connetterti al Sito, gli indirizzi in notazione URI (Uniform Resource Identifier) delle risorse richieste, l’orario della richiesta, il metodo utilizzato nel sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta data dal server (buon fine, errore, ecc.) ed altri parametri relativi al tuo sistema operativo e ambiente informatico.

Questi dati vengono utilizzati al fine di ricavare informazioni statistiche anonime sull’uso del Sito e per controllarne il corretto funzionamento; per permettere – vista l’architettura dei sistemi utilizzati – la corretta erogazione delle varie funzionalità da te richieste, per ragioni di sicurezza e di accertamento di responsabilità in caso di ipotetici reati informatici ai danni del Sito o di terzi e vengono cancellati dopo 7 giorni.

 

1. Dati forniti volontariamente

Attraverso il Sito hai la possibilità di fornire volontariamente Dati Personali come il nome e l’indirizzo e-mail per l’iscrizione al servizio di newsletter “ICT Insider” o per contattare ICTLC attraverso il form “Contattaci”. ICTLC tratterà questi dati nel rispetto della Normativa Applicabile, assumendo che siano riferiti a te o a terzi soggetti che ti hanno espressamente autorizzato a conferirli in base ad un’idonea base giuridica che legittima il trattamento dei dati in questione. Rispetto a tali ipotesi, ti poni come autonomo titolare del trattamento, assumendoti tutti gli obblighi e le responsabilità di legge. In tal senso, conferisci sul punto la più ampia manleva rispetto ad ogni contestazione, pretesa, richiesta di risarcimento del danno da trattamento, etc. che dovesse pervenire a ICTLC da terzi soggetti i cui Dati Personali siano stati trattati attraverso il tuo utilizzo del Sito in violazione della Normativa Applicabile.

3. FINALITA’, BASE GIURIDICA E NATURA OBBLIGATORIA O FACOLTATIVA DEL TRATTAMENTO

I Dati Personali che fornisci attraverso il Sito saranno trattati da ICTLC per le seguenti finalità:

1. finalità inerenti l’esecuzione di un contratto di cui sei parte o all’esecuzione di misure precontrattuali adottate su tua richiesta (es: richiesta di contatto tramite il modulo Contatti, registrazione al servizio ICT Insider, ecc.);
2. finalità di ricerche/analisi statistiche su dati aggregati o anonimi, senza dunque possibilità di identificare l’utente, volti a misurare il funzionamento del Sito, misurare il traffico e valutare usabilità e interesse;
3. finalità relative all’adempimento di un obbligo legale al quale ICTLC è soggetto;
4. finalità necessarie ad accertare, esercitare o difendere un diritto in sede giudiziaria o ogniqualvolta le autorità giurisdizionali esercitino le loro funzioni giurisdizionali;

La base legale del trattamento di Dati Personali per le finalità di cui al punto a) è l’erogazione di un servizio o il riscontro ad una richiesta che non richiedono il consenso ai sensi della Normativa Applicabile. La finalità di cui al punto b) non comporta non comporta il trattamento di Dati Personali, mentre a finalità di cui ai punti c) e d) rappresenta un trattamento legittimo di Dati Personali ai sensi della Normativa Applicabile in quanto, una volta conferiti i Dati Personali, il trattamento è invero necessario per adempiere ad un obbligo di legge a cui ICTLC è soggetto o ad esercitare il suo diritto di difesa in giudizio. Il conferimento dei tuoi Dati Personali per la finalità sopra elencate è facoltativo, ma il loro eventuale mancato conferimento potrebbe rendere impossibile riscontrare una tua richiesta o adempiere ad un obbligo legale a cui ICTLC potrebbe essere soggetto.

 

4. DESTINATARI

I tuoi Dati Personali potranno essere condivisi, per le finalità specificate al punto 3, con:

1. soggetti necessari per l’erogazione dei servizi offerti dal Sito tra cui a titolo esemplificativo l’invio di e-mail e l’analisi del funzionamento del Sito che agiscono tipicamente in qualità di responsabili del trattamento di ICTLC;
2. persone autorizzate da ICTLC al trattamento dei Dati Personali che si siano impegnate alla riservatezza o abbiano un adeguato obbligo legale di riservatezza; (es. dipendenti e collaboratori di ICTLC); (a. e b. sono collettivamente “Destinatari”);
3. autorità giurisdizionali nell’esercizio delle loro funzioni quando richiesto dalla Normativa Applicabile.

 

5. TRASFERIMENTI

Alcuni dei tuoi Dati Personali sono trasferiti a Destinatari che si potrebbero trovare al di fuori dello Spazio Economico Europeo. ICTLC assicura che il trattamento elettronico e cartaceo dei tuoi Dati Personali da parte dei Destinatari avviene nel rispetto della Normativa Applicabile. Invero, i trasferimenti si basano alternativamente su una decisione di adeguatezza o sulle Standard Model Clauses approvate dalla Commissione Europea. Maggiori informazioni e copia di questi accordi sono reperibili presso il DPO.

 

6. CONSERVAZIONE DEI DATI

ICTLC tratterà i tuoi Dati Personali per il tempo strettamente necessario a raggiungere gli scopi indicati al punto 3. A titolo esemplificativo, ICTLC tratterà i Dati Personali per il servizio ICT Insider fino a quando non deciderai di disiscriverti dal servizio. Fatto salvo quanto sopra, ICTLC tratterà i tuoi Dati Personali fino al tempo permesso dalla legge Italiana a tutela dei propri interessi (Artt. 2946 e 2947(1)(3) c.c.). Maggiori informazioni in merito al periodo di conservazione dei Dati Personali e ai criteri utilizzati per determinare tale periodo possono essere richieste scrivendo al DPO.

 

7. I TUOI DIRITTI

Nei limiti della Normativa Applicabile, hai il diritto di chiedere ad ICTLC, in qualunque momento, l’accesso ai tuoi Dati Personali, la rettifica o la cancellazione degli stessi o di opporti al loro trattamento, la limitazione del trattamento nonché di ottenere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i dati che ti riguardano.

Ai sensi della Normativa Applicabile, hai in ogni caso il diritto di proporre reclamo all’autorità di controllo competente (Garante per la Protezione dei Dati Personali) qualora ritenessi che il trattamento dei tuoi Dati Personali sia contrario alla normativa vigente.

 

8. MODIFICHE

La presente Privacy Policy è in vigore dal 25 maggio 2018. ICTLC si riserva di modificarne o semplicemente aggiornarne il contenuto, in parte o completamente, anche a causa di variazioni della Normativa Applicabile. ICTLC ti informerà di tali variazioni non appena verranno introdotte e saranno vincolanti non appena pubblicate sul Sito. ICTLC ti invita quindi a visitare con regolarità questa sezione per prendere cognizione della più recente ed aggiornata versione della Privacy Policy in modo che tu sia sempre aggiornato sui dati raccolti e sull’uso che ne fa ICTLC.
